Valuing a Claim
If your claim is successful, you will receive an award of damages, often called compensation. The aim of compensation is to put you, as far as possible, in the same position that you would have been in had the accident not occurred.
The amount of compensation varies in each case. However, damages are awarded in two separate catergories:
General Damages
General damages are designed to compensate you for the pain and suffering that you have experienced and the effects that your injuries have had on your day to day activities.
Special Damages
Special Damages are designed to compensate you for your financial losses and expenses from the date of the accident to trial and for any future ongoing financial losses. There is no financial limit on the level of these damages.
Such damages can include:
- Loss of earnings
- Private medical expenses and therapy
- Costs of aids and equipment
- Travelling expenses
- Damage to your motor vehicle or other personal items damaged in the accident
- Care costs
- Loss of pension rights
- Costs of a case manager
- Costs of special accommodation
- Transport costs
- Costs of managing finances.
We have a good working relationship with a large number of independent medical and non-medical experts who can prepare the specialist reports necessary to value your case.
Interim Payments
Claims for damages following severe injuries will often take a number of years to be resolved, not least because it can take a considerable time for the medical position to be clarified and future needs to be identified.
Interim payments are therefore very important to the injured person, their families and carers. These payments are necessary both to assist financially during this difficult period and also to ensure that any care and rehabilitation can be paid for.
Investment
If you are successful in claiming compensation, it is vital to ensure that your damages provide for your life-long needs.
This can be achieved with careful investment advice.
